  1. SOFTWARE LICENSE AGREEMENT

  3. This legal agreement between you as end user and Sony Music 
  4. Entertainment (Australia) Limited (Sony Music) concerns this product, 
  5. hereafter referred to as Software.  By using and installing this disc 
  6. to run the Software on a personal computer, you agree to be bound by 
  7. the terms of this agreement.

  9. 1. LICENSE; COPYRIGHT; RESTRICTIONS
  10. You may use your copy of the Software on a single computer. You may 
  11. not network the Software or otherwise use or install it on more than 
  12. one computer or terminal at the same time. The Software (including 
  13. any images, text, photographs, animations, video, audio, and music) 
  14. is owned by Sony Music or its affiliates or suppliers and is 
  15. protected by Australian copyright laws and its international treaty 
  16. provisions. You may not rent, distribute, transfer or lease the 
  17. Software. You may not reverse engineer, disassemble, decompile or 
  18. translate the Software.

  20. 2. TERMINATION
  21. This licence is effective until terminated.  You may terminate this 
  22. licence at any time by not using the CD in a CD-ROM drive.  This 
  23. licence will terminate immediately without notice from Sony Music if 
  24. you fail to comply with any provision of this licence.

  26. 3. DISCLAIMER OF WARRANTY ON SOFTWARE
  27. You expressly acknowledge and agree that the use of the Software is 
  28. at your sole risk.  The Software is provided AS IS and Sony Music 
  29. does not warrant that the Software will operate error free or 
  30. uninterrupted while in use.  All warranties, representations, 
  31. promises, conditions or statements regarding the Software (including 
  32. without limiting the generality, warranties, representations, 
  33. promises, conditions and statements as to merchantability, 
  34. suitability or fitness for any purpose, profitability or any other 
  35. attributes or consequences of or benefits to be obtained from or in 
  36. the course of using such Software) whether express or implied, and 
  37. whether statutory or otherwise are to the full extent permitted by 
  38. law in the jurisdiction of sale hereby expressly excluded.

  40. 4. LIMITATION OF LIABILITY
  41. Under no circumstances, including negligence, shall Sony Music or its 
  42. affiliates be liable for any incidental, special or consequential 
  43. damages that result from the use or inability to use the Software 
  44. even if Sony Music or an Authorised representative or licensee of 
  45. Sony Music has been advised of the possibility of such damages.
  46. In Australia the liability of Sony Music for a breach of a condition 
  47. or warranty in this agreement is limited to any one or more of the 
  48. following (at Sony Music's option):-
  49. (a) replacement of the goods or the supply of equivalent goods;
  50. (b) the payment of the cost of replacing the goods or of acquiring 
  51. equivalent goods.

  53. 5. CONTROLLING LAW AND SEVERABILITY
  54. This licence shall be governed by and construed in accordance with 
  55. the laws of the jurisdiction of sale.  If for any reason a court of 
  56. competent jurisdiction finds any provision of this licence or portion 
  57. thereof to be unenforceable, that provision of the licence shall be 
  58. enforced to the maximum extent permissible so as to effect the intent 
  59. of the parties, and the remainder of this licence shall continue in 
  60. full force and effect.  No amendment to or modification of this 
  61. licence will be binding unless agreed in writing and signed by a duly 
  62. authorised representative of Sony Music.
